The purpose of this agenda item is to seek approval from the Houston Independent School District (HISD) School Board to authorize the submission of a waiver application to the Texas Education Agency (TEA) by August 31, 2026, for the district's Senate Bill (S.B.) 1882 prekindergarten (pre-K) partnership between Piney Point Elementary School (ES)-Kid's Learning Academy and Collaborative for Children. HISD is requesting the waiver due to inadequate time to negotiate revised partnership agreements necessary to implement the new 85-percent pass-through funding requirement.

House Bill (H.B.) 2 requires that a partnership between a school district or charter school and a private pre-K provider must provide that at least 85 percent of funds are passed to the private pre-K provider as updated in Texas Education Code 29.153(i) from the 89th legislative session. The funding a district receives should be a good faith estimate of the total amount of funding a district receives for the student. This includes funds from regular program funding, the early education allotment, state compensatory education funding, special education funding, bilingual funding, tier two funding, other direct (e.g. small and mid-sized allotment, allotment for basic costs, school safety, etc.), and other indirect (e.g. proportionate share of teacher retention allotment) funding, but does not need to include interest and sinking (I&S) funding.
